Annotation

The article is devoted to the study of the regulatory and legal consolidation of changes in state religious policy that occurred during the period of Gorbachev’s perestroika (1985–1991) and led to the democratization of the position of the Russian Orthodox Church (ROC) in the USSR. The article examines the problems of the development and adoption of Soviet and Russian legislation on religious organizations in 1989–1990. In the period 1985–1991. The legal status of the Russian Orthodox Church seriously changed; it gradually freed itself from administrative pressure from the Soviet state and from attempts to regulate internal church life, and its authority in society grew steadily. At the same time, opportunities arose for full inclusion in the life of Soviet / Russian society. However, further democratization of the position of the Russian Orthodox Church in the country was hampered by the current Soviet legislation, adopted in previous years and which did not reflect the real situation of religious organizations in the country. In 1989–1990 this problem was solved by the adoption of Soviet and Russian laws on religious organizations. Soviet law, unlike Russian law, was less focused on creating a strong public organization from the Russian Orthodox Church. Russian law became the basis for churchstate relations in the country in the new post-Soviet realities and opened up a whole range of different types of activities for the Russian Orthodox Church, but at the same time did not hinder (or rather even facilitate) the formation of the Russian Orthodox Church as a strong public organization. The Soviet law lost force with the collapse of the USSR, and the Russian one for almost the entire period of the 1990s. became the basis for state religious policy during the transition period of the 1990s.
